Terms and conditions

These terms are between you and Mesamigos Ltd (“we”), 128 City Road, London, EC1V 2NX, United Kingdom, company number 15765239. They cover Ok Donkey on iOS and Android.

By asking for a sign-in code, you agree to these terms and to the privacy policy.

The service

Ok Donkey does one job. You create an event for a time. The app raises a reminder and keeps alerting until someone marks it done. You can share an event. One person can be nagged first. If they do not mark it done, the others are alerted after the grace period.

A free service, as is

Ok Donkey is a free service for personal and household use. These terms are not a commercial contract, and nothing here is a service-level agreement. We promise no uptime, support, response time, or particular feature, and we may change, limit, or stop the service at any time. We give no guarantee of any kind. You use it as it is, at your own risk.

What the app is not

Ok Donkey is a reminder. It is not a medical device, a care service, or an emergency service. You stay responsible for the task, including medication, school collection, or anything else you put in an event. Do not use the app as the only reminder where a missed alert could cause harm.

A reminder can fail. On iPhone, Focus, Silent, and Do Not Disturb can hide the sound. On Android, the phone maker can stop a background app unless you allow exact alarms and exclude Ok Donkey from battery restrictions. A reminder on your own phone is scheduled on the device and can fire without a connection. Telling someone else’s phone needs a network connection.

Time zones and holidays

Each time is shown on the clock of the phone looking at it, from the time zone that phone reports and the one the event was set in. A phone set to the wrong zone, a clock change, a travel choice, or an owner’s answer can make a time look wrong or ring when you did not expect it. The times shown on other people’s clocks and the questions the app asks are conveniences, not promises.

A holiday pauses your reminders. No alert reaches you, and nothing counts as missed against you. Others on shared reminders take your turns, and a reminder only you are on does not ring. You are responsible for starting and ending your holiday and for telling anyone who depends on you. Do not rely on time zone handling or on holiday for anything where a missed or late alert could cause harm.

Your account

You sign in with your email and a one-time code. There is no password. Keep access to that inbox. You are responsible for what happens on your account. Do not share the code.

Events and other people

You choose the title, the optional photo, and who is invited. Invite only people who should see that event. They can see the title, the photo, the schedule, whether it was marked done or skipped, and the log of what happened: when the alarm rang on each person’s phone, nudges, hand-offs, and who marked it done.

You keep ownership of the text and any photo you add. You allow us to store it and show it to the people on that event, only so the service can run. One event holds one photo, and anyone already on the event can replace or remove it.

• Do not use the app to harass anyone.
• Do not put unlawful content in an event.
• Do not put someone else’s private or health details in a title or photo unless they would expect the people on that event to see them.

Acceptable use

Do not misuse the service, try to break into it, or overload it. We may suspend an account that is used unlawfully or in a way that harms other people or the service. Where we can, we will tell you why.

Availability and changes

The app is in active development. Features can change, and the service can be interrupted. We may update these terms. When we do, we change the date at the top. If you keep using the app after that, the new terms apply. If you do not agree, stop using the app and ask us to delete your account.

Closing your account

You can delete your account in the app. Or email hello@mesamigos.com from the address on the account and ask us to delete it. We delete the account data described in the privacy policy. An event that someone else owns stays on their account, without you on it.

Liability

Ok Donkey is provided free, “as is” and “as available”, without any warranty or guarantee. We build it and run it with reasonable care, and we do our best to protect your data, but we do not promise that the app will work without interruption or error, that a reminder will always be heard, delivered, on time, or acted on, or that your data will never be lost or exposed. Use of the app is at your own risk. To the extent the law allows, we are not liable for any loss or damage, direct or indirect, that comes from using the app or not being able to use it, including a reminder that did not ring, rang late, or rang at an unexpected time.

Nothing in these terms removes liability for death or personal injury caused by negligence, for fraud, or for any right that UK or EU consumer law does not let us exclude. If you use the app as a consumer, you keep your rights under the Consumer Rights Act 2015 and, if you live in the EEA, the mandatory consumer law of your country.

Law and contact

These terms are governed by the laws of England and Wales. You can bring a claim in the courts of England and Wales. If you live in the UK or the EEA, you can also use the courts where you live, and you keep the mandatory protections of that country.
